This page explains our Terms of Service. When you use the Virtual Summer Camp or any program offered by Make Your Perfect, a subsidiary of Tmuffin LLC (“MYP”), you’re agreeing to the rules here.

Terms of Service

These Terms & Conditions & User Agreement (also herein “terms and conditions”, “Agreement” or “agreement”) set forth MYP (also herein, the “Company”, “we”, “us” or “our”) and you the user (also herein, “you”, “your”, “user” or “User”, also in many circumstances may be referred to as “subscriber”, “member”, “VIP”, or “affiliate”, agree to respect and treat each other while and after you are using our website, pages and other information published through http://makeyourperfect.com or any of its subdomains.

Please read these terms of service (“Agreement” or “Terms”) carefully before using the services offered by MYP. This agreement sets forth the legally binding terms and conditions for your use of the various websites and applications owned and operated by MYP, including, without limitation, thevillage.makeyourperfect.com website and domain name (“sites”), and any other content, features or applications offered periodically by MYP in connection therewith, including any mobile applications offered by MYP (collectively, the “service”).

When you use the sites or the service in any way, including but not limited to visiting or browsing the sites, you agree to be bound by this agreement.

Acceptance of Terms

You represent and warrant that if you are an individual, you are of legal age to agree to these terms and conditions or you have your parents’ permission to do so, and that all registration information you submit (including any details you submit for a parent or guardian) is accurate and truthful. MYP may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the Service is revoked in such jurisdictions.

Modification of Terms of Use

These Terms and Conditions may be modified at any time by MYP. Please review them periodically. Your ongoing use is subject to the terms and conditions as modified as well as all other operating rules, policies and procedures that may be published from time to time on the sites by MYP. Your continued participation in MYP after such modification shall be deemed to be your acceptance of any such modification. If you do not agree to these Terms and Conditions, please do not register to become a member of MYP.

Terms of Participation

Member must be 18 years of age or older to participate. Members must provide MYP with accurate, complete and updated registration information, including an accurate name and email address.

To the full extent allowed by applicable law, MYP at its sole discretion and for any or no reason may refuse to accept applications for membership.

Members may not (i) activate or use more than one Member account; (ii) select or use an email Address of another person; (iii) use a name subject to rights of another person without authorization from that person; (iv) use a false or misleading name, mailing address, or email address to activate or use a Member account.

By signing up for any MYP program, Member is opting in to receive other special offer emails from MYP. If you do not wish to receive these emails, you may cancel your account anytime.

MYP reserves the right to track Member’s activity by both IP Address as well as individual browser activity.

MYP has the right, in its sole discretion, to suspend or cancel, at any time and for any or no reason, a Member’s membership in and access to the MYP sites and services. Access to any of the sites and services may be canceled at MYP’s sole discretion, and the Member may be referred to appropriate law enforcement agencies if such action is deemed warranted by MYP.

Member agrees not to abuse his or her membership privileges by acting in a manner inconsistent with this Agreement. Member agrees not to participate in any fraudulent behavior of any kind.

MYP shall be the sole determiner in cases of suspected abuse, fraud, or violation of its rules. Any decision MYP makes relating to the cancellation of Earnings and the termination of membership shall be final and binding.

Spamming is strictly prohibited. Spamming any members of the program or users of the sites will result in immediate termination of your account and a forfeiture of your member resources. Incidents will be dealt with on a case-by-case basis.

Member shall comply with all laws, rules, and regulations that are applicable to Member. Member acknowledges that Member may only participate in the MYP services if and to the extent that such participation is permitted by such laws, rules, and regulations.

If member objects to any of the Terms and Conditions of this Agreement, or any subsequent modifications to this agreement, or becomes dissatisfied with the services, Member’s only recourse is to immediately discontinue participation in the MYP programs and services and properly terminate his or her membership.

Privacy

MYP’s current Sites privacy statement is located at http://makeyourperfect.com (the “Privacy Policy”) and is incorporated into these Terms of Use. Rules and Conduct

MYP is a positive place. Let’s keep it that way.

As a condition of use, you promise not to use the Service for any purpose that is prohibited by the Terms of Use. The Service (including, without limitation, any Content, or User Submissions (both as defined below)) is provided only for your own personal, non-commercial use. You are responsible for all of your activity in connection with the Service. For purposes of the Terms of Use, the term “Content” includes, without limitation, any advertisements, advice, suggestions, videos, audio clips, written forum comments, information, data, text, photographs, software, scripts, graphics, and interactive features generated, provided, or otherwise made accessible by MYP or its partners on or through the Service.

By way of example, and not as a limitation, you shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any content on or through the Service, that:

• infringes any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity;
• is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another’s privacy, tortious, obscene, offensive, or profane; constitutes unauthorized or unsolicited advertising, junk, spam or bulk e-mail (including without limitation any postings to third party social media sites which are linked to the Site or the Service);
• involves commercial activities and/or sales without MYP’s prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes;
• contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of MYP or any third party; or
• impersonates any person or entity, including any employee or representative of MYP.

Additionally, you shall not: (i) take any action that imposes or may impose (as determined by MYP in its sole discretion) an unreasonable or disproportionately large load on MYP’s (or its third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Service or any activities conducted on the Service; (iii) bypass any measures MYP may use to prevent or restrict access to the Service (or other accounts, computer systems or networks connected to the Service); or (iv) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Sites.

You shall not (directly or indirectly): (i) decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Service, except (A) for any part of the Service which is licensed under an open source or similar license or (B) to the limited extent applicable laws specifically prohibit such restriction, (ii) modify, translate, or otherwise create derivative works of any part of the Service except where license permits, or (iii) copy, rent, lease, distribute, or otherwise transfer any or all of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws and regulations.

MYP reserves the right to remove any Content from the Sites or Service at any time, for any reason (including, but not limited to, upon receipt of claims or allegations from third parties or authorities relating to such Content or if MYP is concerned that you may have violated the Terms of Use), or for no reason at all.

Registration

When signing up for MYP, provide honest and authentic information. You are responsible for your account and any material/activity on it.

As a condition to using certain aspects of the Service, you will be required to register with MYP and select a password and user ID. You shall provide MYP with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Service, which may result in immediate termination of your MYP account. You shall not (i) select or use as a MYP User ID a name of another person with the intent to impersonate that person or (ii) use as a MYP User ID a name subject to any rights of a person other than you without appropriate authorization

MYP reserves the right to refuse registration of, or cancel a MYP User ID in its sole discretion. You are solely responsible for activity that occurs on your account and shall be responsible for maintaining the confidentiality of your MYP password. You shall never use another user’s account without such other user’s express permission. You will immediately notify MYP in writing of any unauthorized use of your account, or other account related security breach of which you are aware.

MYP has access to passwords for purposes to assist members with their accounts and password retrieval. MYP may be able to create a new password for members.

Fees and Payment; Subscriptions; Refunds; Promotions

Only those 18 and older can make purchases from MYP. We have a right to change our fees and prices at any time. We will provide advanced notice if there is a change to a recurring payment. You’re responsible for any and all additional charges associated with purchases (taxes, tariffs, exhange rates, international fees, etc.).

For paid Services, you must provide MYP with a valid credit card or PayPal account to pay for such Services. You acknowledge and agree that only an adult (18 years of age or older) can enter into any transaction or subscription with respect to to such paid Services. Some Services may be available as a one-time purchase, and others can be purchased as a monthly subscription. Depending on where you transact with us and where your payment method was issued, your transaction with us may be subject to foreign exchange fees or differences in prices because of exchange rates. JAM does not support all payment methods, currencies, or locations for payment. All applicable taxes are calculated based on the billing information you provide us at the time of purchase.

Monthly subscriptions billed on a monthly basis may be cancelled at any time but are not eligible for a refund. One-time purchases are not eligible for a refund.

If the payment method you use with us, such as a credit card, reaches its expiration date and you do not edit your payment method, MYP may suspend your account.

From time to time, MYP may offer promotions or discounts on services and Products available through the Site. All promotions or discounts will be subject to any additional terms specified by MYP, and unless otherwise indicated, (i) promotions and discounts may not be combined (i.e., one promotion per order), and (ii) promotions may not be applied to previous purchases.

MYP reserves the right to change its prices and to institute new charges at any time, upon posting such new pricing on the Site, which may also be sent by email. Use of the Service by you following such notification constitutes your acceptance of any new or increased charges.

Third Party Sites

If you click on a link that directs to another website or service, you will be bound by that website or company’s terms and conditions.

The Service may permit you to link to other websites or resources on the Internet, and other websites or resources may contain links to the Sites. When you access third party websites, you do so at your own risk. These other websites are not under MYP’s control, and you acknowledge that MYP is not responsible or liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. The inclusion of any such link does not imply endorsement by MYP or any association with its operators. You further acknowledge and agree that MYP shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such Content, goods or services available on or through any such website or resource.

Governing Law

This agreement shall be construed under the laws of the state of North Carolina.

Survival

All obligations of the parties hereto contained in this agreement shall survive the expiration or termination of this agreement.

Arbitration

All claims and disputes arising under or relating to these terms and conditions are to be settled by binding arbitration in the county of New Hanover or Brunswick, North Carolina, USA, or another location mutually agreeable to the parties. An award of arbitration may be confirmed in a court of competent jurisdiction. Should any arbitration be commenced between the parties to this agreement concerning this agreement, or the rights and duties of either in relation thereto, the party prevailing in such arbitration shall be entitled, in addition to such relief as may be granted, to its attorneys’ fees and costs in the arbitration.

Limitation of Liability

Company shall not be liable for any loss of profits or costs, or for any direct, indirect, special, incidental or consequential damages, including costs associated with the procurement of substitute goods or services (whether Company was or should have been aware or advised of the possibility of such damage), arising out of or associated with any loss, suspension or interruption of service, termination of this Agreement, use or misuse of our content, or other performance of services under this Agreement.

Indemnification

User agrees to defend, indemnify and hold harmless the Company, its officers, affiliates, directors, agents, and employees from and against any and all property damage, personal injuries or death and other liability, loss, cost, expense, or damage, including, without limitation, court costs and reasonable attorney’s fees arising out of user’s use or misuse, whether intentional or negligent, of the Company’s content and information and from user’s breach of any of the terms contained in this agreement.

Counterparts

This agreement may be executed in several counterparts or by separate actions between or among its parties, each of which shall constitute an original and all of which, when taken together, shall constitute one agreement; it’s understood that your accessing and using the information on this website constitutes your complete assent (and, as applicable, the assent of the company, group or organization you represent) to all of these terms and conditions.

The headings for sections herein are for convenience only and shall not affect the meaning of the provisions of this agreement.
